What happens if someone dies without a will in Jamaica?+
When a person dies intestate (without a will), the estate is distributed according to the Intestates' Estates and Property Charges Act. The court appoints an administrator, and assets are distributed based on a statutory formula that prioritises the surviving spouse and children.
How long does the probate process take?+
The probate process in Jamaica typically takes 6 to 12 months, depending on the complexity of the estate, whether the will is contested, and the time needed to gather all required documents. We work to move the process along as efficiently as possible.
Do I need a lawyer to apply for a Grant of Probate?+
While it is technically possible to apply without an attorney, the process involves legal and administrative steps that can be complex. An attorney ensures all documents are properly prepared, filed, and that the estate is administered in compliance with Jamaican law.
Can probate be handled from overseas?+
